The Fifth District Appellate Court Of Illinois held that a covenant not to compete, which is expressly set forth in a physician's employment contract, was not enforceable. Writing for the Appellate Court, Justice Goldenhersh stated that the public policy of allowing patients the freedom to choose their own physician was paramount to the contractual rights of the physicians.
